Senate Bill (SB) 205

Stormwater permit compliance is now tied to business licensing for certain industrial businesses.

SB 205 — Stormwater Permit Compliance

SB 205 is a California law that strengthens stormwater compliance requirements for certain industrial businesses. The law requires eligible businesses to demonstrate enrollment in the State’s Industrial General Stormwater Permit program before a city or county can issue or renew a business license.

Businesses subject to the Industrial General Permit must obtain coverage through the Stormwater Multiple Application and Report Tracking System (SMARTS), administered by the California State Water Resources Control Board. Proof of enrollment is verified during the local business licensing process.

By linking business licensing with stormwater permit compliance, SB 205 helps reduce pollutants entering storm drains, streams, and rivers. The law supports improved water quality and ensures that regulated facilities implement appropriate stormwater management practices.

Businesses should consult their local licensing agency or the State Water Board’s Stormwater Program for information on eligibility and enrollment requirements.
